Not quite, he was not wearing a seatbelt at the time of the accident and I'd bet he was a willing participant in the reckless behavior.

That said, the driver's responsibility is to make sure everyone in their car has a seatbelt on when in their vehicle. Nick was at the wheel on that fateful night and should suffer the extent of the law for his actions.

Unfortunately, his passenger and family will suffer the most from his stupidity.
